EVENT TERMS AND CONDITIONS

These Event Terms and Conditions apply to events organised or convened by Mines and Environment, including conferences, summits, workshops, symposiums, seminars, webinars, livestreams and other events promoted through www.minesandenvironment.com.au.

By purchasing or registering for a ticket to an Event, the purchaser and registered delegate acknowledge and agree to these Event Terms and Conditions.

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy available under the Australian Consumer Law or other applicable legislation where it would be unlawful to do so.

1. DEFINITIONS

For the purposes of these Terms and Conditions:

“Event” means any conference, summit, workshop, symposium, seminar, webinar, livestream or other event organised or convened by Mines and Environment.

“Event Organiser” means Mines and Environment, ABN 84 123 926 956.

“Delegate” or “Attendee” means the person registered to attend an Event.

“Ticket” or “Registration” means a confirmed registration to attend an Event.

2. REGISTRATION AND PAYMENT

Each registration is valid for one Delegate only and must not be shared between multiple people.

Full registration details and payment must be received no later than 24 hours before the Event unless otherwise agreed by Mines and Environment.

Mines and Environment reserves the right to refuse admission where registration fees have not been paid in full.

Delegates are responsible for having their Event registration or ticket available electronically or in printed form where requested for admission.

3. CANCELLATIONS AND NO-REFUND POLICY

All registrations are final and non-refundable for attendee-initiated cancellations, except where a refund or other remedy is required by the Australian Consumer Law or other applicable law.

Once a registration has been confirmed, Mines and Environment commits to costs based on confirmed delegate numbers.

These may include venue hire, catering, staffing, administration, suppliers, equipment and other Event delivery costs which may remain payable by Mines and Environment regardless of whether a registered Delegate ultimately attends.

Accordingly, a refund will not be provided where a Delegate chooses not to attend or becomes unable to attend, including due to:

a change of mind;

  • illness or personal circumstances;

  • changes to business or work commitments;

  • inability to obtain employer or management approval;

  • scheduling conflicts;

  • changes to travel plans;

  • flight delays or cancellations;

  • inability to travel;

  • failure to make appropriate travel or accommodation arrangements; or

  • any other attendee-initiated cancellation or inability to attend.

Failure to attend the Event does not entitle a Delegate or ticket purchaser to a refund.

Delegates are encouraged to make use of the ticket-transfer provisions below where they are unable to attend.

Nothing in this section excludes, restricts or modifies any statutory right or remedy that cannot lawfully be excluded.

4. TICKET TRANSFERS AND DELEGATE SUBSTITUTIONS

Where a registered Delegate is unable to attend, the registration may be transferred to another person at no additional charge.

Mines and Environment must receive the replacement Delegate's:

  • full name;

  • email address;

  • company or organisation; and

  • accessibility requirements, if applicable,

at least 24 hours before the Event.

Delegate substitutions cannot ordinarily be processed on the day of the Event.

Dietary requirements should be provided at least seven days before the Event. Mines and Environment cannot guarantee that new or amended dietary requirements can be accommodated where a substitution is made within seven days of the Event.

Registrations cannot be shared between Delegates.

5. PROGRAM CHANGES

The advertised Event program is provided as a guide and is subject to change.

Mines and Environment and its Event partners will make every reasonable effort to deliver the Event substantially as advertised, including scheduled speakers, session times and topics.

However, Mines and Environment reserves the right to make reasonable changes where necessary, including:

  • substituting, adding or withdrawing speakers;

  • changing presentation topics or session content;

  • changing session times or the order of presentations;

  • combining, replacing, rescheduling or removing individual sessions;

  • changing the Event format or method of delivery; or

  • making other reasonable changes due to unforeseen circumstances or matters beyond our reasonable control.

Where practicable, Mines and Environment will endeavour to communicate significant changes to registered Delegates using the email address supplied at registration.

Where a significant change is known sufficiently in advance, we will aim to provide at least seven days' notice. However, changes may occur at short notice or on the day of the Event and advance notification cannot be guaranteed.

6. SPEAKERS

All advertised speakers are subject to availability.

If a scheduled speaker becomes unavailable or is unable to present, Mines and Environment will make reasonable efforts to secure a suitable replacement speaker with relevant expertise or provide an appropriate alternative session.

Where a replacement cannot reasonably be arranged, the relevant session may be amended, rescheduled, replaced or removed from the program.

A speaker substitution, withdrawal or other minor program change does not, by itself, constitute cancellation of the Event and does not automatically entitle a Delegate to a refund.

Where a change is sufficiently significant to give rise to a statutory right or remedy under the Australian Consumer Law or other applicable legislation, those rights will apply.

7. POSTPONEMENT, RESCHEDULING OR RELOCATION

Mines and Environment reserves the right to postpone, reschedule, relocate or change the delivery format of an Event where reasonably necessary due to circumstances beyond its reasonable control.

These circumstances may include, but are not limited to:

  • government restrictions or directions;

  • a declared State of Emergency;

  • natural disasters;

  • severe weather;

  • public health or safety concerns;

  • venue unavailability;

  • industrial action;

  • significant transport disruption;

  • failure of essential services; or

  • other circumstances that make proceeding as originally scheduled unsafe, unlawful, impracticable or unreasonable.

Where an Event is postponed, rescheduled or relocated, Mines and Environment will endeavour to notify registered Delegates as soon as reasonably practicable.

Any entitlement to a refund, credit, transfer or other remedy in these circumstances will be determined in accordance with the Australian Consumer Law and other applicable legislation.

8. EVENT CANCELLATION

If Mines and Environment cancels an Event and does not reschedule the Event or provide a reasonable alternative, registered Delegates will receive any refund or other remedy to which they are entitled under applicable law.

Where a refund is payable, Mines and Environment will advise registered Delegates of the applicable refund process.

9. TRAVEL, FLIGHTS AND ACCOMMODATION

Delegates are responsible for arranging and paying for their own travel and accommodation associated with attending an Event.

This includes, without limitation:

  • airfares and flights;

  • hotels and other accommodation;

  • taxis and rideshare services;

  • transfers and ground transportation;

  • car hire;

  • parking;

  • travel booking fees;

  • travel amendment or cancellation fees; and

  • other associated travel expenses.

Mines and Environment strongly recommends that Delegates make flexible or refundable travel and accommodation arrangements and consider appropriate travel insurance.

To the maximum extent permitted by law, Mines and Environment and its Event partners are not responsible for travel, accommodation or associated costs or losses incurred as a result of:

  • a Delegate cancelling or being unable to attend;

  • a speaker substitution or withdrawal;

  • a program or scheduling change;

  • postponement or rescheduling;

  • relocation or change in Event format; or

  • cancellation of the Event.

Nothing in this section excludes or limits any entitlement to compensation or reimbursement that a Delegate may have under the Australian Consumer Law or other applicable legislation and which cannot lawfully be excluded.

10. TRAVEL AND EVENT INSURANCE

Delegates are responsible for determining whether they require travel, cancellation, personal accident or other insurance in connection with attending an Event.

Mines and Environment recommends that Delegates travelling to an Event consider appropriate insurance and flexible or refundable travel and accommodation arrangements.

Except where liability cannot lawfully be excluded, Mines and Environment is not responsible for costs incurred because a Delegate has failed to obtain appropriate insurance or refundable travel arrangements.

11. SPEAKER VIEWS AND OPINIONS

The statements, opinions, analysis and conclusions expressed by speakers, presenters, panellists and other Event participants are their own.

They do not necessarily represent the views of Mines and Environment or its directors, employees, agents, advisers, affiliates or Event partners.

The inclusion of a speaker in an Event does not constitute endorsement by Mines and Environment of the speaker's opinions, statements, organisation, products or services.

12. EVENT CONTENT AND PROFESSIONAL ADVICE

Presentations, discussions, papers, handouts, recordings and other Event materials are provided for general information and educational purposes.

Unless expressly stated otherwise, Event content is not intended to constitute legal, financial, investment, taxation, environmental, engineering, technical or other professional advice.

Delegates should obtain appropriate independent professional advice before making decisions or acting upon information presented at an Event.

Mines and Environment does not warrant that information supplied by independent speakers, presenters or contributors is complete, current, accurate or appropriate for a Delegate's individual circumstances.

13. FINANCIAL INFORMATION DISCLAIMER

Any financial or investment-related information presented through Mines and Environment Events or associated platforms is general information only unless expressly stated otherwise.

It does not take into account an individual's objectives, financial situation or needs.

Before acting on financial or investment-related information, Delegates should consider whether the information is appropriate to their circumstances and obtain independent professional advice where appropriate.

Where applicable, Delegates should also review any relevant Product Disclosure Statement, disclosure document or other applicable information before making an investment decision.

14. DELEGATE CONDUCT

Delegates are expected to conduct themselves professionally, respectfully and safely while participating in an Event.

Mines and Environment is not responsible for statements, communications or conduct of individual Delegates or other participants.

Mines and Environment reserves the right to refuse admission to, or remove from an Event, any person whose conduct is reasonably considered unsafe, disruptive, abusive, discriminatory, unlawful or materially detrimental to the Event or its participants.

Where a Delegate is removed for such conduct, no refund will be provided except where required by law.

15. ADMISSION AND CONFLICTS OF INTEREST

Mines and Environment reserves the right, where reasonably necessary, to refuse registration or attendance where there is a genuine commercial conflict of interest, safety or security concern, or other legitimate reason connected with the proper conduct of the Event.

Any such decision will be made subject to applicable law.

16. PERSONAL PROPERTY

Delegates are responsible for their personal belongings while attending an Event.

To the maximum extent permitted by law, Mines and Environment is not responsible for loss, theft or damage to personal property at an Event.

Delegates should keep valuables and personal property secure at all times.

17. PHOTOGRAPHY, FILMING AND RECORDING

Photography, filming and audio or video recording may occur during Mines and Environment Events.

Photographs and recordings may capture a Delegate's image, likeness or voice and may be used by Mines and Environment for legitimate Event-related, promotional, educational, archival and communications purposes, including websites, publications and social media, subject to applicable privacy and other laws.

Delegates who do not wish to be photographed or recorded should contact Mines and Environment before the Event and, where practicable, notify Event staff upon arrival.

Mines and Environment will consider reasonable requests concerning the use of identifiable photographs or recordings.

18. WEBINARS AND LIVESTREAM EVENTS

Where an Event is delivered using a third-party webinar, livestreaming, conferencing or technology provider, information necessary to register for and deliver the service may be provided to that service provider.

Personal information will be handled in accordance with applicable privacy laws and the Mines and Environment Privacy Policy.

While reasonable measures are taken in relation to online Event delivery, Mines and Environment cannot guarantee uninterrupted internet access, continuous availability of third-party platforms or that online services will be completely free from technical difficulties or unauthorised access.

Nothing in this provision limits an obligation or liability that cannot lawfully be excluded.

19. LIMITATION OF LIABILITY

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other applicable legislation where doing so would be unlawful.

Subject to those statutory rights and to the maximum extent permitted by law, Mines and Environment and its directors, employees, agents, advisers and Event partners exclude liability for indirect or consequential loss arising from participation in an Event, reliance upon Event content or changes to Event arrangements.

Where liability cannot lawfully be excluded, Mines and Environment's liability will be limited only to the extent permitted by applicable law.

20. AUSTRALIAN CONSUMER LAW

Our services come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

Nothing contained in these Terms and Conditions is intended to exclude, restrict or modify any consumer guarantee, condition, warranty, right or remedy provided by the Australian Consumer Law or other applicable legislation where it would be unlawful to do so.

Where a Delegate has a statutory entitlement to a refund, compensation, damages or another remedy, that entitlement will apply notwithstanding anything contained in these Terms and Conditions.

Except where required by law, attendee-initiated cancellations remain non-refundable.

21. CHANGES TO THESE TERMS AND CONDITIONS

Mines and Environment may update these Terms and Conditions from time to time.

The Terms and Conditions presented in connection with a Delegate's Event registration will apply to that registration, subject to any subsequent amendment required by law or agreed with the Delegate.

IMPORTANT BOOKING NOTICE

All attendee-initiated cancellations are non-refundable except where a refund or other remedy is required by law.

Please ensure that you are able to attend before completing your registration. If you become unable to attend, your registration may be transferred to another person in accordance with these Terms and Conditions.

Delegates travelling to the Event are strongly encouraged to arrange flexible or refundable flights and accommodation and consider appropriate travel insurance.

By completing your registration, you acknowledge that you have read and agree to these Event Terms and Conditions.
